Navigating Legal Barriers in Climate and Environmental Technologies
Abstract
As global efforts intensify to combat climate change and advance sustainable development, climate and environmental technologies have emerged as critical tools in achieving environmental resilience and innovation. However, deployment and scaling of such technologies often encounter complex legal and regulatory barriers that can hinder progress. This chapter explores the legal challenges surrounding the development, implementation, and diffusion of climate technologies. It examines international treaties, national regulations, intellectual property regimes, liability standards, and market mechanisms such as carbon trading. Particular attention is given to environmental justice, technology transfer, and public-private partnerships in addressing these legal constraints. By analyzing case studies from developed and developing jurisdictions, the chapter identifies key friction points and proposes reform pathways. Ultimately, it provides a strategic lens through which STM stakeholders can navigate legal complexities while promoting ethical and sustainable technological innovation.
